Overlapping Jurisdictions 4.PDF

چکیده
This paper discusses the common pool problems that arise when multiple territorially overlapping governments share access to a common tax base. Contrary to a competitive Tiebout model in which increasing the number of governments in an area increases competition and improves efficiency, when jurisdictions overlap, increasing the number of governments worsens externalities and a “tragedy of the fiscal commons” results. The model is tested empirically with data from U.S. counties. The number of special purpose governments in a county is taken as a proxy for the degree of jurisdictional overlap. I find a strong positive relationship between the number of special districts and the size of the local public sector (whether measured in revenues or expenditures), after controlling for other relevant variables. Substantively, the “overlap effect” is on the order of 5 to 7 percent of the total budget. I explore, and reject, several alternative explanations for these findings, including the endogeneity of special district creation. This fiscal commons approach to the local public sector is particularly timely as special districts have become the most numerous and fastest-growing type of local government in the U.S. This approach poses a substantial challenge to conventional models based on a foundation of Tiebout-competition.

Legal Competition in the Medieval World
We develop a model of competition between legal systems with overlapping jurisdictions based on Hotelling competition that suggests that, absent institutional reform, courts with overlapping jurisdictions will be driven to adopt divergent legal doctrines in order to extract rents from agents with heterogeneous preferences over which doctrine is applied to their case. This has the effect of weak...

متن کاملIndependent Cities and Counties in Virginia: Substitute Jurisdictions?
Cities and counties are overlapping jurisdictions in most US states. Virginia cities, however, are independent of counties, with separate tax bases and residents. This paper examines whether the Virginia system creates a horizontal relationship resembling that among cities in other states. It uses revealed preference axioms to compare spending patterns against competitive median voter benchmark...
متن کاملEducation costs and institutional structure
An empirical comparison is made of the impact on disaggregated education costs of three types of education spending control regimes — state-level control of education spending; local school board control of spending with non-overlapping jurisdictions; and local school board control with overlapping jurisdictions. A model is specified which describes the determination of teacher wages, the teach...
متن کاملTypes of Multi-Level Governance
The reallocation of authority upwards, downwards, and sideways from central states has drawn attention from a growing number of scholars in the social sciences. Yet beyond the bedrock agreement that governance has become (and should be) multi-level, there is no convergence about how it should be organized. This paper draws on various literatures in distinguishing two types of multi-level govern...
